Call for consumer protection in contracts unnecessary

The Trade Practices Commission's call for protection for consumers in home building contracts is unnecessary in Western Australia, where Government legislation was enacted earlier this year.

Consumer Affairs Minister Yvonne Henderson said today that the Commission's concern for consumers in other States was further evidence of the importance of WA's Home Building Contracts Act, which came into force in April.

The Commission has recommended a warranty plan among 30 major changes to Australia's home building industry.

"Our legislation was historic, and one of the most important pieces of consumer protection legislation undertaken by this Government," Mrs Henderson said.

"Because of it, people have contractual protection when they undertake home building work - the greatest financial commitment for most of us.

"This Government acted to protect consumers against shoddy home building work and to give buildings confidence that the industry cannot be affected by irresponsible actions of a very small section."

Mrs Henderson said the Act covered deposits, quotes, price variations, defects liability and disputes.

"We have obtained consumer protection and industry stability in Western Australia and I would be more than pleased for other States to examine our legislation and follow suit," Mrs Henderson said.
